Trading Standards Prosecutions
The belief that the sale of counterfeit goods and video and music piracy is often linked to organised crime has led to authorities prioritising the investigation and prosecution of Trading Standard offences. Common offences investigated by Trading Standards departments include trademark infringements, breaching labelling regulations, sale of unsafe products and fraudulent advertising.
An investigation will usually start with a search of premises and seizure of assets followed by an interview under caution. During this interview the suspect has the right to legal representation to ensure it is conducted lawfully and to guard against the risk of self-incrimination.
Should the investigation result in a prosecution the full range of criminal sentences may apply along with ancillary orders. These include forfeiture of the business assets found to have breached trading standards regulations, confiscation of any “proceeds of crime”, disqualification for directors and revocation of alcohol and tobacco licences.
